Appeal your Ticket

You have 30 days to request an appeal, from the time the ticket is issued. There are two stages to an appeal of your penalty order/ticket.

Stage 1: Request Review of Penalty Order by Screening Officer

You can appeal your Penalty Order by completing an online request for a review of the Penalty Order by a Screening Officer.

Screening Reviews are conducted by a Screening Officer. If you choose to dispute your ticket you must request a review within 30 days of the service date noted on the penalty order.   

 

Preparing for your Screening Review 

Screening Reviews are conducted virtually, either via telephone or virtual meeting. In-person reviews are accommodated when requested 

 

If you are not the registered owner of the vehicle, you must complete the Authorization to Act as Agent form in order to act on the owner’s behalf.  

 

Please bring copies of any documents that may assist as evidence, including: 

  • Photographs 

  • Proof of financial hardship 

  • Medical notes 

  • Other supporting information 

Screening Review Procedure 

The Screening Officer will review and consider any documents you submit before making a decision. During the Screening Review, the Screening Officer may: 

  • Set Aside the Penalty Order, including any administrative fees; 

  • Confirm the Penalty Order, including any administrative fees; 

  • Reduce the amount owing on the Penalty Order, including any administrative fees; or 

  • Extend the time for paying the Penalty Order, including any administrative fees. 

Please Note: If you fail to appear on the date and time of your Screening Review you will be charged a Non-Appearance Fee of $60.00. 

 

Screening Decision and Payment 

At the conclusion of the Screening Review, a Notice of Decision will be provided to the appellant. Penalty orders will be forwarded to MTO for licence plate denial if a screening review has not been submitted and the penalty amount has not been paid by the due date. A late payment fee of $20 will be added to penalty orders forwarded to the MTO.  

 

If you are not satisfied with the Notice of Decision, you may request a Hearing Review within the prescribed time period

Stage 2: Request Review of the Screening Officer's Decision by a Hearing Officer

You may appeal the decision of a Screening Officer by requesting a Hearing Review within the prescribed time afforded within the Screening Review Notice of Decision.

Please Note: If you are in financial hardship and require time to pay, please bring documents to support your claim. The Town does not provide language interpreters for Screening or Hearing Reviews. If you require the use of an interpreter, it is your responsibility to provide one. 

 

Preparing for your Hearing Review  

Requests for a Hearing Review may be made through our online platform. If you plan on attending the Hearing Review but are not the registered owner of the vehicle, you must complete the Authorization to Act as Agent form in order to act on the owner’s behalf.  

 
The Town is not required to have the issuing Officer present at Hearing Reviews and may rely on certified evidence as set out in Ontario Regulations. No witnesses are permitted to participate in the Hearing Review

Hearing Review Procedure 

Hearing Reviews are conducted virtually, either on the telephone or via virtual meeting. Requests for in-person Hearing Reviews will be accommodated on a case-by-case basis.  
 
For your scheduled Hearing Review, please review the important information below: 

 

The Town of Bradford West Gwillimbury promotes a respectful work environment and has zero tolerance for aggressive, coarse, or inappropriate language during a hearing review.  A Hearing Officer reserves the right, in their sole discretion, to adjourn the hearing in the event an appellant’s behaviour becomes inappropriate. 

 

Be On Time 

Meetings may extend beyond the scheduled time. Appellants must attend their scheduled appointment on time and remain on the line until the hearing commences. If you experience technical issues, please communicate with the Hearing Officer for assistance. If you are unable to connect to Teams at the start of your meeting, please call the BWG ASE main line at 1-877-711-3169 as soon as possible. 

 

Come Prepared

In accordance with Ontario Regulations, a Hearing Officer may consider the following information:  

  1. Undue Financial Hardship – recipient of government assistance such as CPP, EI, Ontario Works, ODSP 

  2. Extenuating Circumstances – circumstances assessed on a case-by-case basis by the Hearing Officer 

Show proof of your financial hardship by having documentation available such as an eligibility letter or approval, bank deposit records, or other records that can prove you are an active recipient of government assistance.  The Hearing Officer may ask you to show additional documentation.  Any reduction is at the discretion of the Hearing Officer. 

 

Technical Requirements

Please have your devices charged and ensure you are in a quiet area. Please note that we require at least three (3) days’ notice for cancellations and/or rescheduling of the appointment. 

 

Cancellation Policy

The cancellation or rescheduling of your hearing may be done in accordance with the below conditions: 

  1. Cancellation Window: Cancellations or rescheduling must be made at least three (3) days prior to the scheduled Review.  

  2. Late Cancellation Procedure: If an emergency or unforeseen circumstance prevents you from attending within the 3-day window, please contact us immediately at 1-877-711-3169 or by email at BWGASE@townofbwg.com. However, be aware that cancellations made within this time frame may still be subject to our policy. 

  3. No-Show and Late Cancellations: Failure to attend a scheduled Review or cancel within the required time frame may result in penalties or forfeiture of certain privileges. Failure to attend your hearing will result in a $60.00 no-show fee being added to the Penalty Order. 

Hearing Outcome 

The Hearing Officer will issue a Notice of Decision shortly after the conclusion of the Hearing Review.  This decision includes the Hearing Officer’s reasons for confirming, varying or setting aside the Penalty Order.  The Hearing Officer’s decision is final and not subject to further appeal. 

 

Penalty orders will be forwarded to MTO for licence plate denial if the penalty amount has not been paid by the due date. A late payment fee of $20 will be added to penalty orders forwarded to the MTO.

 

Disclosure Requests

In an effort to be as transparent as possible, the Town is providing routine disclosure of relevant documents relating to ASE camera locations. Below you can access information such as: Certificate of Accuracy, Location Maps, and photos of the signage for each respective location. As camera locations frequently rotate, please ensure you are selecting the location at the date and time in which you receive your ticket.

If you require any information beyond what is posted on this website, please follow the following:  

  • Disclosure will only be provided where a Hearing Review has been scheduled. 

  • Requests for disclosure shall be made in writing, using the Town’s “ASE Request for Disclosure” form by the Owner or an Authorized Agent, a minimum of fifteen (15) calendar days prior to the scheduled Hearing Review. 

  • Contents of disclosure includes the issued Penalty Order, Certified Statements by authorized person, Authorized person designation and camera system information. 

  • The Town shall provide all relevant information pertaining to the scheduled Hearing Review, upon receipt of a completed “ASE Request for Disclosure” form.
