Notice of the Passing of a Zoning By-Law
Pursuant to Section 34(18) and 36 of the Planning Act, R.S.O. 1990, c. P.13, as amended
Take notice that the Council of The Corporation of the Town of Bradford West Gwillimbury passed By-law 2024-21 amending Zoning By-law 2010-050 on the 2nd of April, 2024 under section 34 and 36 of the Planning Act, R.S.O. 1990, c. P.13, as amended, in respect of the lands municipally known as 281 Barrie Street. A key map showing the location of the lands to which the by-law applies is attached.
The purpose of By-law 2024-21 is to rezone the lands from the “Residential Three Exception- Two” (R3*2) Zone to a dual Residential Two Exception (R2-2*14) and (R2-2*15) Zone with a Holding (H) Provision, for the purpose of facilitating the development of four (4) townhouse blocks consisting of a total of twenty-seven (27) dwelling units with an internal road. The Holding "(H1)" symbol will be removed once a development agreement has been executed. A key map showing the location of the lands is attached. The complete by-law is available for public inspection by contacting the Office of Community Planning at planninginfo@townofbwg.com.
Any person or public body may appeal to the Ontario Lands Tribunal in respect of Council's decision by filing a notice of appeal with Tara Reynolds, Clerk, of The Corporation of the Town of Bradford West Gwillimbury, 100 Dissette Street, P.O. Box 100, Bradford, Ontario, L3Z 2A7, which must be received no later than April 25th, 2024. The notice of appeal must set out the reasons for the appeal and must be accompanied by the OLT form (available from the OLT website at www.elto.gov.on.ca) and fee of $1,100.00 payable to the Minister of Finance.
In conformity with section 34(18.1) of the Planning Act, public comments/submissions and response to same are set out in Report No. PLN 2024-8 which is available for viewing on the municipal website at https://shorturl.at/dyNRY or by contacting the Office of Community Planning at planninginfo@townofbwg.com.
Only individuals, corporations, and public bodies may appeal a zoning by-law to the Ontario Lands Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or group on its behalf.
No person or public body shall be added as a party to the hearing of the appeal unless, before the By-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the Council of the Town of Bradford West Gwillimbury or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
